Client Contract
Sample Client Flower Preservation Agreenment
This Flower Preservation Agreement (“Agreement”) is between Lucia Designs LLC (“Lucia Designs,” “we,” “us,” or “our”) and the client identified above (“Client” or “you”). By signing below, Client agrees to the following terms.
1. FLOWER PRESERVATION & NATURAL VARIATION
Floral preservation is a handmade process involving natural materials. Flowers may change in color, shape, texture, size, or appearance during drying and preservation. Lucia Designs uses professional preservation, color-restoration, and reshaping techniques with the goal of bringing Client’s flowers as close as reasonably possible to their original appearance, but exact results cannot be guaranteed.
The condition of the finished preservation also depends on the condition of the flowers when received. Lucia Designs is not responsible for deterioration or damage that occurred before the flowers were received.
Finished resin and pressed-flower pieces may contain small bubbles, slight variations in flower placement, natural botanical debris, minor surface variations, or other characteristics associated with handmade floral preservation. Resin may also naturally yellow or otherwise change in appearance over time.
These natural and handmade variations are not considered defects.
2. DESIGN & MOCK-UPS
Lucia Designs will use professional artistic judgment when selecting and arranging Client’s flowers. Not every flower received can necessarily be used, and flowers may be trimmed, separated, reshaped, pressed, dried, color restored, or otherwise altered as necessary for preservation and design.
Eligible Lucia Designs preservation pieces include a digital mock-up. Roses Only orders and accessory items do not receive mock-ups.
Mock-ups provide an overall representation of the design and are not intended to show the exact final placement of every flower. Client may approve the mock-up or request changes. Significant redesigns or changes may result in additional charges.
Client must respond to a mock-up within 30 days. Once a design has been approved and casting, framing, assembly, or other final production has begun, additional changes cannot be made.
3. DEPOSITS, PAYMENT & CANCELLATION
A deposit or full payment is required to reserve a Client's date. A $350 deposit is required for each main preservation piece ordered. All deposits are non-refundable and are applied toward the order.
If multiple main pieces are ordered, the required deposits may be paid in full or in installments. Lucia Designs will begin work on each individual piece once the required $350 deposit for that piece has been received.
For orders that include a mock-up, full payment must be received before the mock-up can be created. For orders that do not receive a mock-up, full payment must be received before final production begins. Delayed payments may delay the project.
If Client cancels before the mock-up is created, a partial refund of payments made beyond the non-refundable deposit may be available depending on the stage of the project and work already completed. Refunds are considered case by case and are not guaranteed.
Once a mock-up has been created, all payments are non-refundable. For orders that do not receive a mock-up, all payments become non-refundable once the final production stage has begun.
If applicable, dried flowers may be returned to Client. Client is responsible for applicable return shipping costs.
4. LATE BOOKING FEES & APPOINTMENT CHANGES
Because floral preservation is time-sensitive, reservations made shortly before or after an event may require expedited coordination, scheduling, or supplies.
A $50 late booking fee applies to reservations made within 5 days before the event. A $100 late booking fee applies to reservations made after the event. Late booking fees are waived for memorial projects.
All flower drop-offs are by appointment only. Client may make one appointment time change at no additional charge. Any additional appointment time changes are subject to a $30 rescheduling fee.
If Client arrives more than 30 minutes late, a Lucia Designs team member may no longer be available to meet for the scheduled appointment. In that event, Client may be asked to leave the flowers in the designated drop-off area for retrieval by a team member as soon as reasonably possible, or Client may be required to reschedule the appointment. Any rescheduling required because Client arrived more than 30 minutes late will be subject to a $30 rescheduling fee, regardless of whether Client has previously rescheduled the appointment.
5. TIMELINE
Preservation timelines are estimates and may vary based on the order, flowers, payment timing, requested changes, Client response time, workload, supplies, and other circumstances.
Roses Only projects may take up to approximately six months.
For Lucia Designs orders, mock-ups may take approximately three months for Classic and Detailed bouquets and up to six months for Intricate and Signature bouquets following final payment. After mock-up approval, final production may take up to an additional three months.
These timeframes are estimates and are not guaranteed completion dates.
6. INACTIVE & ABANDONED ORDERS
If Lucia Designs is waiting for a response from Client and does not receive one within 30 days, the order will be considered inactive.
Lucia Designs will then notify Client in writing that Client has six months from the date of that notice to contact Lucia Designs to continue the preservation or arrange to have the flowers returned. Lucia Designs will send an additional reminder after approximately three months.
If Client does not respond by the end of the six-month period, the flowers will be considered abandoned and released to Lucia Designs. Lucia Designs can no longer guarantee that the flowers will remain available for return or preservation after that time.
7. SHIPPING & RISK
Client is responsible for following Lucia Designs’ shipping and drop-off instructions and for the cost of sending flowers to Lucia Designs. Lucia Designs is not responsible for flowers lost, delayed, or damaged while in transit to us.
Completed pieces are packaged with care. Lucia Designs is not responsible for loss or damage occurring during transit after a finished piece has been transferred to the shipping carrier. If a shipment is lost or damaged, Lucia Designs will reasonably assist Client with appropriate next steps or an eligible carrier claim.
Finished pieces measuring 10 inches or under include complimentary shipping within the U.S. when purchased through a U.S. location and within Canada when purchased through a Canadian location. Pieces with any measurement larger than 10 inches are subject to shipping charges.
8. IRREPLACEABLE FLOWERS, CARE & LIABILITY
Client and Lucia Designs acknowledge that wedding, memorial, funeral, anniversary, and other sentimental flowers may be unique and impossible to replace. Although Lucia Designs takes reasonable professional care when handling flowers and finished artwork, preservation involves fragile natural materials and cannot be completely risk-free.
If flowers or artwork are damaged due to an error by Lucia Designs, Lucia Designs may, depending on the circumstances and available materials, repair or recreate the affected item, provide a credit, or refund amounts paid for the affected item.
Client is responsible for properly caring for finished artwork. Lucia Designs is not responsible for damage or changes caused by improper handling, storage, cleaning, display conditions, environmental exposure, or the natural aging of flowers or resin after delivery.
9. PHOTOGRAPHY & GENERAL TERMS
Lucia Designs may photograph Client’s flowers and finished artwork for business records, portfolio use, its website, social media, advertising, and other marketing purposes. Lucia Designs will not intentionally publish Client’s private contact information. Client may opt out of public marketing use by notifying Lucia Designs in writing before the project is completed.
Lucia Designs is not responsible for reasonable delays caused by circumstances outside its control, including severe weather, natural disasters, shipping disruptions, supply shortages, utility interruptions, illness, emergencies, or similar events.
